Eleven years ago MERS quietly gained private support from the seven biggest banks and the four largest title insurers, while their regulatory agencies were silenced by the Congress. Their self-proclaimed and silently imposed business model (the automated MERSmin tracking number) has destroyed clear title on 66MM+ homes all across this nation.  If the recent events in Nevada and Massachusetts mean anyone with MERS on their mortgage can’t be foreclosed on, then it only follows that anyone buying or selling real estate can’t deliver clear title. They aren’t telling you this. They are showing it to you but they are leaving it to you to THINK it all the way through.

The reason they invented MERS was so they could keep the Mortgage or Deed of Trust immobile while they did whatever they wanted to with the debt instrument and the cash flow that went with it.  In short, they separated your Note from your Deed of Trust.

 

In 1873, the Supreme Court of the United States ruled in Carpenter v. Longen that such an act is an impossibility going so far as to say that it was “…a thought which has mis-led many an able mind.”  We translate that to mean:

 

It is a thought which no rational mind can conceive, but they did it anyway…we are all now paying the price for their wrong doings!

 

The purpose of a clear chain of title and owner’s title insurance is to make sure there is no person or identity who might show up at some future date trying to enforce a claim upon your title.

 

If an identity shows up outside the clear chain of title as recorded at the courthouse, you can tell them to pound sand.  Even if the person can prove the legitimacy of the claim, it is up to you to verify that you really DO possess a title insurance policy to cover any losses!

 

Clear title is critical.  Clear title means the person who is buying your home doesn’t have any surprises.   Clear title means if you are buying it, you don’t have any surprises.  Clear title means the lender who is financing the deal doesn’t have any surprises.  Title insurance means that if there is a surprise, they shall bear the financial burden.

 

The title companies are in on the game. They write their policies around today’s clouds, pat you on the head and make you think all is fine. Truth is, TODAY all isn’t fine. Clouded titles mean they are forever clouded until they are quieted by legal action.

 

The MERScurse has hopelessly clouded the title on over 66MM households all across the United States.  If you have MERS on your Mortgage, you are buying nothing.
